In this "Policy: Science and Society" paper in Science, an Associate Justice of the U.S. Supreme Court presents a reasoned discussion of various approaches to the use of expert scientists as consultants or witnesses in courts and the advantages and disadvantages of each. Efforts have been made by the judiciary to improve the quality of the science on which scientifically-related judicial determinations will rest. Breyer strongly believes that in this age of science we must build legal foundations that are sound in science as well as in law.
